Gap Year Job News

A judge has said that the law which dictates the rights of people who are in temporary work should be reformed.

The comments were made by the judge after a landmark case involving an agency workers attempt to sue Greenwich Borough Council for hiring a permanent worker to replace him, reports Personnel Today.

Although the case was won by the council, the lead judge said that the money spent on the case would have been better spent on lobbying for a change of the laws regarding temp work.

Mark Hammerton, employment partner at Eversheds law firm, said: "In short, this decision represents perhaps only short-term relief for employers. Should the government lose sufficient allies in the EU, the issue of enhanced protection may be taken out of the UK's hands."

In this case the court ruled that the temporary worker had no contractual relationship with the council despite the fact that they had worked there for several years.

The Agency Workers Directive, if it is introduced, would give people in temporary jobs more rights in cases such as this although employers have spoken out against it.

Backed by unions, the bill is due to be read in parliament on February 22nd.
